What is a pension by age and who is eligible for it?

Mandatory state social insurance is a monthly payment to citizens to compensate for the salaries and other incomes received by the insured before they are awarded a labor pension. If the pension capital registered in the insurance part of the personal account allows to provide a pension not less than the minimum amount of the labor pension, regardless of the length of service, and if it does not allow this pension, at least 25 years of insurance experience (except for individuals receiving an age pension until July 1, 2017) are required to be entitled to an age pension.

The Law on Amendments to the Law of the Republic of Azerbaijan "On Labor Pensions," approved by the President of the Republic of Azerbaijan, Mr. Ilham Aliyev, on December 21, 2018, entered into force on January 1, 2019. In cases where the pension is not determined automatically, after collecting the required documents, the application is submitted to the DOST Center or a structural unit of the State Social Protection Fund.

Periods of work or other activities included in the insurance record:

Regardless of the form of ownership, nature and duration of employment, military servicemen, as well as individuals engaged in entrepreneurial activities without establishing a legal entity, working in enterprises, departments and organizations on the basis of an employment contract (agreement), regardless of the form of ownership, the nature and duration of employment, the length of service, military service or other activity of the elected or appointed persons shall be included in the insurance record.

In addition to the insured's length of service, the following periods are included:

The duration of any work for which the employee is paid a mandatory state social insurance fee on the salary calculated by the employer;
The period following the start of creative activity of members of creative unions and professional associations, and from January 1, 1991, the period of payment of compulsory state social insurance premiums to the relevant executive authority;
Period of active military (alternative) service (including active military service in the territory of the former USSR before January 1, 1992), the period of stay in self-defense groups and formations registered with the relevant executive authority, military service in the relevant executive authorities, and military service term in other state bodies (bodies included in the structure of state bodies);
Period of care for a person with a first-degree disability or a child under 18 years of age with disabilities, as well as the elderly (persons over 70 years of age), calculated in accordance with the procedure established by the relevant executive authority;
Period of unemployment insurance payment or period of retraining of the unemployed;
Period of retirement of persons with first and second degree disabilities who are not working as a result of industrial accidents or occupational diseases until they reach the age limit for determining the age pension;
The period during which the wives of officers, ensigns, midshipmen, and overtime servicemen live with their husbands in places where they are unable to get a job in their specialty;
Periods of illegal detention, imprisonment, and incarceration, as well as periods of inactivity due to illegal dismissal;
During the period of temporary incapacity for work, the period during which benefits are received at the expense of both the employer's funds and compulsory state social insurance funds;
The period during which persons owning land suitable for agriculture pay compulsory state social insurance premiums for that land in accordance with the legislation;
Term of military service (including military service in the territory of the former USSR before January 1, 1992).

You need to know

Appointment is made by considering the submitted application for the appointment of labor pension and the list of documents determined by the body that determines the labor pension within 10 days from the day they are received by the body that determines the labor pension. Applications and list of documents of the citizens of the Republic of Azerbaijan permanently living abroad determined by the body determining the labor pension are submitted to the relevant executive authority through the diplomatic missions or consulates of the Republic of Azerbaijan where they are in consular records.

In cases where the applicant does not have the right to a labor pension, the decision of the body that determines the labor pension to refuse to grant a pension shall be sent to the applicant (citizens of the Republic of Azerbaijan permanently living abroad) through the diplomatic missions or consulates of the Republic of Azerbaijan where they are in consular records, along with all the documents, provided that the reasons for the refusal are indicated within 5 days. with) sends.

Persons with the right to labor pension under preferential conditions

Regardless of the last place of work, special fields of art that give the right to receive an age-based labor pension on preferential terms, underground, jobs with particularly harmful and difficult working conditions (productions, professions, tasks and indicators) approved by the body (institution) determined by the relevant executive power body men who have worked for at least 12 years and 6 months in the jobs specified in the list, and women who have worked for at least 10 years, have the right to an age-related labor pension, under the conditions stipulated in Article 7 of the Law of the Republic of Azerbaijan "On Labor Pensions", with the age limit reduced by 5 years.

Persons suffering from hypovisganism and dwarf persons with physiological disproportion have the right to an age-related labor pension with a 20-year reduction in the age limit stipulated in Article 7 of this Law if they have at least 5 years of insurance experience.

The age in accordance with Article 7 of the Law of the Republic of Azerbaijan "On Labor Pensions" if those who work in positions related to the work of the civil aviation flight and flight test crew have at least 25 years of insurance experience for those jobs, and those who have been exempted from flight work for health reasons have at least 20 years of insurance experience for those jobs. he has the right to an age-related labor pension with the limit reduced by 15 years.

The following persons who have served in prosecutor's offices (except for prosecutor's office employees who have been deprived of special ranks) have the right to an age-related labor pension:

employees of the prosecutor's office who have served at least 35 years in prosecutor's offices;
employees of the prosecutor's office whose service in the prosecutor's office has been terminated due to age, with a total length of service of 35 years or more, and who have served in the prosecutor's office for at least 17 years and 6 months of this length of service.

The following military personnel (except military personnel who have been deprived of military ranks, military personnel with a term of active military service) have the right to an age-related labor pension as a military personnel:

military personnel who have served in the military for 25 calendar years or more until discharge from military service;
persons who have been discharged from military service due to age, have 30 calendar years or more of total work experience, and have spent at least 15 years of this experience in military service;
persons who have been discharged from military service due to illness or limited capabilities of their health, as well as downsizing, and who are 48 years old or older on the day of discharge, have 30 calendar years or more of total work experience, and have spent at least 15 years of this experience in military service;
military personnel who have served for 15 years or more and participated in the removal of the consequences of the accident at the Chernobyl NPP in the relocation zone.

Age-related labor pension for military personnel is assigned after discharge from military service. With the exception of the following persons, recalculation of the labor pension according to the last provision cost of labor pensioners who have been re-enlisted after the age-related labor pension as a military serviceman is not allowed:

persons who have served at least 72 months from the date of re-enlistment;
persons restored to military service by a legally binding decision of the court;
persons deceased while performing military service duties;;
persons belonging to the staff of senior officers.

Judicial employees with at least 35 years of service in positions with special ranks in judicial bodies (except for judicial employees deprived of special ranks) have the right to an age-related labor pension.

Migrant workers with at least 35 years of service in positions with special ranks in migration authorities (except for migrant workers deprived of special ranks) have the right to an age-related labor pension.

Employees with at least 35 years of service in positions with special ranks in emergency authorities (except for employees of emergency authorities deprived of special ranks) have the right to an age-related labor pension.
