Labor pension for the loss of the head of the family

The following family members of the head of the family who died or died have the right to a labor pension for the loss of the head of the family:

• children of deceased persons:
  
  • Under the age of 18;
  • A person with a disability over the age of 18 whose disability has been determined before reaching the age of 18;
  • Those studying in the full-time department of educational institutions, but up to the age of 23;
• If the father, mother, husband, wife has reached the retirement age determined in accordance with Article 7 of the Law of the Republic of Azerbaijan "On Labor Pensions" (hereinafter - the Law), or is disabled due to a 61-80 percent or 81-100 percent impairment of body functions if he is a person;
• Regardless of age and working capacity, if one of the parents or the husband (wife), or grandfather, grandmother, brother, sister takes care of the children, brothers, sisters, grandchildren of the deceased head of the family under the age of 8 and does not work.

In the event that the insured person is declared missing or dead in accordance with the legislation, his family members have the right to a labor pension for the loss of the head of the family on the same basis as the family members of the deceased or deceased head of the family.

Labor pension due to the loss of the head of the family is assigned if the total insurance period of the head of the family is not less than 5 years until the day of death, and 4 months of insurance period for each full year of the working age period (except for those who were assigned a labor pension due to the loss of the head of the family until the date of entry into force of the Law) is being

The labor pension due to the loss of the head of the family is assigned to the persons who have reached the retirement age determined in accordance with Article 7 of the Law for the period of time, based on the application of the person who is entitled to it, for the period of time that the conditions specified in Article 14 of the Law exist.
