Providing persons with disabilities with special vehicles

How is the process of providing rehabilitation facilities carried out?

Within 10 (ten) working days from the date of determination of disability, information on the time and place for the development of the Individual Program is sent to one of the means of communication of the person with disabilities and (or) his legal representative through the Centralized Electronic Information System of the Ministry of Labor and Social Protection.

If the person with a disability does not have a legal representative, as well as if the legal representative or the person with a disability informs the Medical Social Expert Commission that he / she will not be able to participate in the development of the program, the program is prepared at his / her place of residence.

The individual rehabilitation program is prepared by the Medical Social Expert Commission with the participation of the person with a disability and (or) his / her legal representative within 2 (two) working days. The developed Individual program is submitted to Centralized Electronic Information System within 1 (one) working day.

The Medical Social Expert Commission determines the need for rehabilitation of a person with a disability.

Rehabilitation means shall be handed over to a person with a disability or his / her legal representative on the basis of an identity document or a permanent residence permit in the territory of the Azerbaijan Republic, and in the case of a legal representative - on the basis of a power of attorney.

 

Where the rehabilitation equipment may be acquired?

Since the date of identification of relevant instructions on rehabilitation means in the Individual Rehabilitation Program, cars are provided by the DOST Centers of the Social Services Agency or the Sustainable and Operational Social Security Agency under the Ministry of Labor and Social Protection, and other rehabilitation facilities by the State Medical-Social Expertise and It is handed over to them by the Prosthetic and Orthopedic Rehabilitation Center or the DOST Center under the Rehabilitation Agency at the request of the person with a disability or his / her legal representative.

 

Who has the right to be provided with a car by the state?

In connection with the protection of the territorial integrity, independence and constitutional order of the Republic of Azerbaijan, by car of persons with disabilities, by the events of January 20, 1990, by performing military service duties, by performing military service duties (service duties) at the Chernobyl NPP, as well as persons with disabilities identified in connection with the liquidation of the accident at the Chernobyl NPP have the right to be provided with a free car in the general queue.    

 

Registration of passenger cars

The car is registered as a property of the Ministry of Labor and Social Protection. 

 

Can a person with a disability be assigned both a car and a wheelchair?

If the medical prescription states that a person with a disability needs both a car and a wheelchair, one of them shall be appointed at the discretion of the person with a disability.

If a person with a disability wants to receive both means of rehabilitation, the second means of rehabilitation shall be provided to him on a paid basis out of turn. 

 

What happens when a person with a disability who is provided with a car dies?

After the death of a person with a disability, the car remains the property of his family and is deregistered in the name of one of the family members of the deceased person with a disability.

 

What should be done if the designated mechanical wheelchair becomes unusable before the end of its service life?

If the mechanical wheelchairs provided to a person with a disability become unusable before the end of their service life, at the request of the person with a disability or his / her legal representative, the Prosthetic and Orthopedic Rehabilitation Center shall inspect the rehabilitation facilities within 3 (three) working days. Unless its repair is possible, it is replaced by a new one by the Center by drawing up a protocol by the technical commission.

In accordance with the Decision No. 501 of the Cabinet of Ministers of the Republic of Azerbaijan dated December 18, 2020, the terms of repair and replacement of rehabilitation aids provided to persons with disabilities vary depending on the type of rehabilitation facility. 

 

In what form is the queue carried out and where can it be followed?

A person with a disability is provided with a car or a wheelchair in accordance with the sequence established by the Individual Rehabilitation Program.In accordance with the “Conditions and Rules for Provision of Persons with Disabilities with Rehabilitation Means”, information on a person with a disability is included in the queuing list in the centralized electronic information system on the day of the decision to assign a car or a wheelchair.

A person with a disability can get information about his / her turn from the e-social.az internet portal of the Ministry of Labor and Social Protection. 

 

What is an individual rehabilitation program?

An individual rehabilitation program is a social program that includes a set of measures related to the medical, vocational, psychological and pedagogical rehabilitation and development of social skills of a person with a disability.

 

How long does an individual rehabilitation program take?

The individual program is developed for the period for which the disability is determined, and for the period of 5 (five) years if the disability is determined indefinitely. The Medical Social Expert Commission determines the duration of each rehabilitation measure, not exceeding the duration of the individual program.

If a person with a disability and (or) his / her legal representative refuses to compile an individual program, this issue shall be acted by the Medical Social Expert Commission within 1 (one) working day and entered into the centralized electronic information system on that day.

 

Electronic monitoring of individual rehabilitation program

The developed individual program is reflected in a special section of the personal account of the person with a disability on the "e-social" Internet portal. The personal cabinet contains personal information of the person with a disability, degree of disability, cause and duration of disability, date of approval of the individual program, rehabilitation measures to be implemented under the program, their start and end dates, as well as their implementation status.

 

Medical conditions for which diseases are the basis for the state to provide free cars to people with disabilities:

1. second (II B) grade chronic circulatory failure;

2. pulmonary insufficiency, grade II;

3. paralysis of the lower extremities or marked paresis;

4. hemiplegia, marked hemiparesis;

5. marked ataxia, hi - perkinetic amiostatic syndrome;

6. Chronic thromboobliterative diseases of both lower extremities, II degree arterial insufficiency, diseases of the lower peripheral veins, II-III degree venous insufficiency in both lower extremities, with trophic disorders;

7. elephantiasis of both lower extremities;

8. both paws are driven at the level of Shopar or higher;

9. lower limbs or thighs;

10. Ankylosis of both hip and pelvic joints;

11. Diseases and deformities of the spine that make it difficult to stand and move. III-IV degree flexion with severe spinal cord dysfunction;

12. chronic osteomyelitis of a lower peripheral or pelvic bone (with the presence of a fistula or sequestering cavities lasting more than 2 years);

13. If there is a large bone defect (more than half of the bone circumference) in the lower extremity or a long-term incurable ulcer (greater than 10 cm2);

14. Acute dysfunction of the lower extremity as a result of a curved fracture of both thighs or calves, in the presence of acute contracture in both thighs or pelvis;

15. When the visual acuity of both eyes of a person with a disability is less than 0.04 or the visual field is less than 5 (five) degrees.

 

You need to know

It is prohibited to sell or donate a car or a motorized wheelchair given to a person with a disability. The right to drive a car is given to both a person with a disability and a family member with a driver's license living in the same settlement.

In the event of the death of a person with a disability who did not have a family who bought a car or a wheelchair, the car is taken by the Social Services Agency and the wheelchair is taken by the State Medical Social Expertise and Rehabilitation Agency and given to another person with a disability.

Persons with disabilities who are fully covered by the state are not provided with a car in the social service institutions subordinated to the Agency for Social Services.

Until the person with a disability is provided with a car, the Social Services Agency provides them with cash compensation in the amount of 20 percent of the minimum amount of the labor pension twice a year as transportation costs.If there are medical indications for the provision of rehabilitation aids, based on the decision of the medical and social expert commissions of the State Medical-Social Expertise and Rehabilitation Agency, the Social Services Agency will provide a mobile, outpatient and inpatient form for other rehabilitation facilities.  

Control over the compliance of rehabilitation facilities with technical normative legal acts is carried out by the Ministry of Labor and Social Protection.
