Who is considered as a job seeker?

Persons who apply and are registered as job seekers under the Ministry of Labor and Social Protection of the Republic of Azerbaijan for active work in local bodies of the State Employment Agency or "DOST" centers and in cases stipulated by the Law of the Republic of Azerbaijan "On Employment"

 

Who is an unemployed person?

An able-bodied person of working age who is unemployed and ready to start work, registered as unemployed in the local offices of the State Employment Agency under the Ministry of Labor and Social Protection of the Republic of Azerbaijan or in the "DOST" centers

 

What is a vacancy?

The employer’s job vacancy requiring an employee

 

What is meant by a vacancy bank?

Electronic information resource of vacancies of the employer and required employees, as well as newly created jobs

 

What is a new job?

A job created by the employer in addition to the existing staff

 

What is meant by the concept of decent work?

For a job seeker, a job that takes into account his / her education, specialty, experience in his / her previous profession, health, and the ability to travel to and from the proposed job by public transport is considered a suitable job.

 

What is the concept of employment?

Any activity of citizens of the Republic of Azerbaijan, foreigners and stateless persons that does not contradict the legislation of the Republic of Azerbaijan and brings them profit (income)

 

Who are the employed people?

Wage workers - persons who, in accordance with the Labor Code of the Republic of Azerbaijan, conclude a labor contract (contract) with an employer and perform labor activities in the decent workplaces in exchange for wages.

Employees working under contracts of a civil-legal nature - persons who, in accordance with the Civil Code of the Republic of Azerbaijan, enter into a contract with the other party and perform work (services) for a certain fee without establishing an employment relationship;

Entrepreneurs, those who own agricultural land, members of family farms;

Elected, appointed or approved for a paid position;

Serving in the Armed Forces of the Republic of Azerbaijan;

Full-time students in higher and secondary specialized educational institutions engaged in paid activities;

Foreigners and stateless persons engaged in paid employment on the territory of the Republic of Azerbaijan on a legal basis;

Citizens of the Republic of Azerbaijan engaged in labor activity on legal grounds outside the Republic of Azerbaijan.

 

Whom does the employment law apply to?

Citizens of the Republic of Azerbaijan;

Foreigners living in the Republic of Azerbaijan;

Persons not having citizenship.

 

How are citizens registered as job seekers?

Citizens are registered as job seekers in the Centralized Electronic Information System (CEIS) of the Ministry of Labor and Social Protection of Population after filling in an electronic application in the Employment Subsystem.

 

In what case is a job seeker registered as unemployed?

If a person is not offered a suitable job within 5 (five) working days from the date of registration as a job seeker or is refused employment by the employer (employers), local bodies of the State Employment Agency and “DOST” centers under the Ministry of Labor and Social Protection of Population, decides on the registration of the person as unemployed and makes a relevant note in the person's personal employment record.

 

Which categories of people are not allowed to be registered as unemployed?

According to Article 4 of the Law "On Employment", those related to employed persons;

Those under the age of 15;

Full-time students in educational institutions;

Persons who have been granted an old-age pension or old-age benefit in accordance with the laws of the Republic of Azerbaijan “On Labor Pensions” or “On Social Benefits”;

Except for the cases specified in part 1 of Clause 74 and items “b” and “c” of part 2 of Clause 75 of the Labor Code of the Azerbaijan Republic, termination of an employment contract concluded on the basis of a consignment on its own initiative before the term specified in this agreement issuers, within 6 (six) months.

 

Is it possible to change the electronic information of a job seeker and an unemployed person after registration?

In case of change of information on job description and occupation of persons registered as job seekers and unemployed, it is possible to update the information in the electronic information system.

 

In which case is an individual employment list drawn up?

When a person is registered as a job seeker, an individual employment record is compiled electronically based on the information entered into the electronic information system.

 

What is an individual employment record?

It is an electronic document containing personal information on job seekers and unemployed persons, including information on education and profession (specialty), employment history, as well as information on the proposed suitable work and active employment measures and the state of their implementation.

 

What is an individual employment program?

It is an electronic document that defines the specific scope, type and duration of active employment measures, designed to help the unemployed find employment and return to the labor market.

 

In what cases is a person temporarily deregistered as a job seeker?

When called up for military or alternative service, military gatherings, during that period;

If there is a valid court decision on deprivation of liberty or application of compulsory medical measures, within that period;

Within 2 (two) years from the date of registration as a job seeker, within 1 (one) year if he / she does not accept the relevant work offered by the body (institution) determined by the relevant executive authority.

 

In what cases is a person's registration as a job seeker revoked?

When provided with a suitable job;

In case of death or being declared missing or dead on the basis of a court decision that has entered into force;

When distorted or incorrect information is found in the submitted documents and information;

When submitting an electronic application for deregistration as a job seeker.

 

In what cases is a person's registration as unemployed revoked?

Those considered employed under the employment law;

When there are grounds for awarding an old-age pension or old-age benefit in accordance with the laws of the Republic of Azerbaijan “On Labor Pensions” or “On Social Benefits”;

In case of death or being declared missing or dead on the basis of a court decision that has entered into force;

When distorted or incorrect information is found in the submitted documents and information;

When an electronic application for deregistration is submitted;

When visually admitted to an educational institution.

 

For whom are paid public works eligible for paid work that meet the requirements of labor legislation, including temporary jobs that do not correspond to education, specialty and previous professional experience, and do not require prior vocational training?

Those who have not worked for more than 3 years, do not have a profession (specialty);

Those who refuse vocational training;

Those who have been registered for more than 24 months in the local offices of the State Employment Agency under the Ministry of Labor and Social Protection of the Republic of Azerbaijan and in the "DOST" centers.

 

You need to know

Job seekers and unemployed people are not allowed to be offered the same suitable job again.

If the job seeker is required to change his / her place of residence in connection with a new job without his / her consent, as well as if the working conditions do not comply with the norms of labor protection, the job offered to him / her cannot be considered suitable.

A person who is not registered as unemployed or whose registration as unemployed is canceled shall be registered as a job seeker and shall have the right to apply for registration as unemployed again after 1 (one) month.
