Partial funding of social workplace wages

What is a social workplace?

A workplace funded by the Ministry of Labor and Social Protection in accordance with the established procedure for a part of the employee's salary for a vacancy submitted to the employer's vacancy bank in order to ensure the employment of job seekers and unemployed persons and to encourage employers.

 

What is meant by the program of financing the salary of the insured person?

It is the payment of the part of the salaries of the insured person hired under the referral of the State Employment Agency or the DOST Center under the Ministry of Labor and Social Protection of Population of the Republic of Azerbaijan at the expense of unemployment insurance funds for a certain period.

 

Who is eligible to participate in the Insured's Salary Financing Program?

The people registered as unemployed and job seeker in the local offices of the State Employment Agency or in the "DOST" centers under the Ministry of Labor and Social Protection of the Republic of Azerbaijan are entitled to participate in this program.

 

What are the sources of funding for the Insured's Salary Financing Program? 

The program of financing the salary of the insured person is financed by unemployment insurance.

 

 Which category is eligible to participate in this program? 

Persons with disabilities;

Martyr's family members;

Youth;

Persons released from a penitentiary institution;

Persons registered as unemployed for more than a year. 

 

What are the conditions for employers who want to participate in the program? 

People other than legal entities belonging to the state and municipality; Operating in the last 1 (one) year; Having a vacancy or creating a new vacancy in the priority economic sectors and professions (specialties) identified by the State Employment Agency on the basis of the analysis of the labor market.  

 

How can an employer apply to participate in this program? 

Fills in and certifies the “Application for financing the personnel’s salaries at social workplaces” in compliance with the Annex 1 of the Rule of “Financing of a part of the personnel’s salary at the social workplaces by the Ministry of Labor and Social Protection of Population in the “Employment” subsystem of the “Centralized Electronic Information System” (hereinafter - CEIS”)”. 

 

How many days and by which body is the compliance of the insured person in the program of financing the salary of the insured person checked for? 

Within 10 (ten) working days after registration of the application sent in electronic form, the possibility of participation of the employer in this program is investigated by the State Employment Agency and "DOST" centers under the Ministry of Labor and Social Protection of the Republic of Azerbaijan. 

 

What is the next step for an employer tested for eligibility for a payroll program? 

If the employer meets the established conditions, the Agency or the Center will send him an electronic notification. The Agency and the employer conclude an "Agreement on the financing of wages for social jobs." 

 

How is a job seeker assigned to vacancies identified through this program? 

Submission to the vacancies approved by the authorized person of the "DOST" center on the basis of a suitable job offer accepted by the job seeker based on the submission of a referral to social jobs to the employers signed by the State Employment Agency and an extract from the job seeker's personal employment record It is sent electronically to the employer and placed in the job seeker's personal account. The employer and job seeker will make relevant notes in the letter on the decision of the job seeker to refuse to hire for the vacancy or provide the job in accordance with the letter submitted by the DOST Center and confirm this with a strengthened electronic signature by entering the information in the CEIS. 

 

Is an employment contract concluded with the hired citizen? 

Employment of a jobseeker and an unemployed person at a social workplace is confirmed by registration of the notification on the conclusion of an employment contract with him in the "Labor and employment" subsystem of the Ministry.

 

Is there a probationary period when an employment contract is concluded between an employer and an employee joining this program? 

When concluding an employment contract between an employee and an employer, a probationary period may be established in accordance with the Labor Code of the Azerbaijan Republic, provided that it does not exceed 3 (three) months. The employment contract of an employee not having justifying himself during the probationary period may be terminated by a reasoned order of the employer. 

 

How to determine the maximum and minimum amount of the part of the salary financed by unemployment insurance? 

The part of the salary financed by unemployment insurance is determined by the State Statistics Committee of the Republic of Azerbaijan, provided that it does not exceed the average monthly nominal salary established for the previous year. 

 

What part of the insured's salary is financed by unemployment insurance? 

50 percent of the insured person's salary (official salary) and deductions (compulsory state social insurance premium from the remuneration fund, unemployment insurance premium, compulsory insurance premium in case of loss of ability to work as a result of industrial accidents and occupational diseases). 

 

Which payments are not financed by unemployment insurance payments? 

Bonuses, salary supplements, increases (coefficients), as well as payments for overtime work and other payments are not financed from unemployment insurance funds, and these payments are financed by employers in accordance with the Labor Code of the Republic of Azerbaijan. 

 

What is the term of financing the salary by unemployment insurance? 

Salaries of employees hired under an employment contract concluded for a period of not less than 2 (two) years in social workplaces shall be financed for a period of not less than 3 (three) months and not more than 12 (twelve) months.

 

You need to know

The number of the insured people to be involved in the salary financing program for each employer should not exceed 20% of the total number of employees of that employer, but not more than 10 social jobs for each employer.

The amount of salary for workplaces financed by the employer may not differ by more than 10 percent from the amount of salary for other workplaces for the same position (occupation) for which funding is not provided.

If the employee's employment contract is terminated at the initiative of the employer during the contract period (excluding probationary period if the probationary period is established), except for paragraphs “a” and “c” of Article 70 of the Labor Code of the Azerbaijan Republic, a new post shall not be issued.

Legal entities owned by the state and municipalities do not participate in the program to finance the salaries of the insured people as employers.
