The body (institution), determined by the relevant executive authority, ensures the personal, educational, and socio-cultural development of a child placed in an institution for children who have lost their parents and were left without parental care, and determines the possibility of transferring him to family education, draws up an individual development plan the child, taking into account his age, health status, desires and interests, skills and other characteristics.

When drawing up an individual development plan, the opinion of a child who has reached the age of 7 is considered, and if there is a parent or relatives, their participation in drawing up an individual development plan is ensured.

The head of the institution where the child is located is obliged to assist the body (institution) determined by the relevant executive authority in drawing up and implementing an individual development plan.

When a body (institution) determined by the relevant executive authority determines the possibility of returning a child to his family or relatives as a result of the implementation of an individual development plan, the family draws up a development plan to study his situation in the family, the state of mental, physical, psychological and mental health, the authority conducts monitoring in the family at least once a quarter for 1 (one) year after the child returns to the family.

If, as a result of observation carried out after the child’s return to the family, it is determined that there is an immediate threat to the health or life of the child, the body (institution) determined by the relevant executive authority immediately removes the child from the family and places him in the institution and informs the prosecutor about this. Within 10 (ten) working days after the child’s placement, the body (institution) determined by the relevant executive authority may apply to the court with a claim for deprivation of parental rights or restriction of these rights.
