Who is a person with disability?

A person with disability is a person with a permanent physical, mental, mental or emotional disorder that prevents him or her from participating fully and effectively in society on an equal footing with others, including a child under the age of 18 with disabilities.

In order to determine the percentage, cause and duration of impairment of body functions, assessment of disability is carried out by TSEK through the Disability subsystem of the Centralized electronic information system of the Ministry (hereinafter - the subsystem).

A person is considered to have a disability from the date of adoption of the decision on disability assessment until the 1st of the month following the date of the next disability assessment.

Disability is determined based on the main categories of human life activities and their degrees of limitation and the "criteria for determining disability" approved by Resolution No. 187 of the Cabinet of Ministers of the Republic of Azerbaijan dated May 13, 2022.

Disability is not determined in cases of violation of body functions up to 30 percent, and in cases of violation of more than 30 percent, disability is determined by evaluating up to 31-60 percent, 61-80 percent, and 81-100 percent.

81-100 percent in case of III degree limitation of one or more of the categories of human life activity resulting from illness, injury and deficiencies;

61-80 percent in the case of II-degree limitation of one or more of the categories of human life activity resulting from illness, injury and deficiencies;

31-60 percent in the case of I-degree limitation of one or more of the categories of human life activity resulting from illness, injury and deficiencies.

According to the third part of Article 11 of the Law of the Republic of Azerbaijan "On the status and social protection of citizens who took part in the cancellation of the Chernobyl accident and were harmed as a result of that accident", if the disability of the persons specified in the first part of Article 5, Clause 1 of that Law is caused by the Chernobyl accident, disability is defined indefinitely.

In the event that the violation of the functions of the organism determined by specifying the period is determined for 15 consecutive years in the range of 31-60 percent, 10 years in a row in the range of 61-80 percent, and 4 years in a row in the range of 81-100 percent, as well as in different percentage ranges, Ministers of the Republic of Azerbaijan Taking into account clause 4.3 of the "Disability assessment" rule (hereinafter - the Rule) approved by the Cabinet's Resolution No. 11 dated January 16, 2020, if the disability period is 15 years, the disability is determined indefinitely during the next assessment.

Until the date of entry into force of the "Disability Determination Criteria" approved by the Resolution of the Cabinet of Ministers of the Republic of Azerbaijan No. 187 dated May 13, 2022, the disability periods of persons with disabilities are 81-100 percent, 61-80 percent for I, II, and III degrees, respectively. interest and 31-60 percent are included in the periods mentioned in Clause 4.2 of the Regulation. The period of limitation of health opportunities determined until that date is taken into account for the duration of every three percent interval of the body's functions.

Disability is defined indefinitely to persons who have reached the age limit that gives them the right to receive an age-based labor pension (with the exception of an age-based labor pension under favorable conditions) or social benefits, as determined by the laws of the Republic of Azerbaijan "On Labor Pensions" and "On Social Benefits".
